Authorization to extinguish and abandon sanitary sewer and storm drain easements on Montrose Parcel J.
Recommendation
Staff recommends that the Mayor and Council authorize the City Manager to execute document(s), in a form acceptable to the City Attorney, to extinguish and abandon sanitary sewer and storm drain easements on Montrose Parcel J.
Discussion
Existing sanitary sewer and storm drain easements need to be extinguished as a result of development on Martha Terrace. In 2004 the Planning Commission approved Use Permit USE2003-00667 which allowed the Rollins Congressional Clubhouse LLC to improve their pool and clubhouse facilities, including demolition of the exiting pool and clubhouse and rebuilding a new pool and clubhouse. During the redevelopment of this property, it was necessary to relocate the existing sanitary sewer and storm drain pipes to accommodate the new clubhouse. During the project close out, it was observed the existing easements were not extinguished. With new easements in place, we ask the Mayor and Council to grant the City Manager permission to extinguish and abandon the existing sanitary sewer and storm drain easements, now vacated.

Next Steps
The developer will prepare the necessary legal documents to extinguish and abandon older sanitary sewer and storm drain easements on Montrose Parcel J. Staff will review and approve the sketch and description documents physically describing the subject area. The City Attorney will review and approve the legal content of documents. The City Manager will execute the necessary legal documents. The documents will be recorded in the Montgomery County Land Records.
