Recommendation
Staff recommends approval to enter into a Requirements Contract with American Tennis Courts, Inc. of Baltimore, Md. as a rider on Montgomery County Public Schools (MCPS) Solicitation #9163.4 in the amount not to exceed $130,000 for the period through June 30, 2010 with the option to extend the contract for 3 additional 1-year periods subject to appropriation of funds by the Mayor and Council.

Discussion
Work under this contract includes the installation of new athletic courts and the maintenance and repair of existing courts, including asphalt surfaces, color coat, nets, goals, fencing, benches and lighting which are identified in a six year plan which is updated annually.

Mayor and Council History
The City previously awarded a contract to American Tennis Courts, Inc. as a rider under a Fairfax County, Virginia contract in fiscal year 2004, with two option years. A subsequent contract was awarded as a rider on a MCPS contract in fiscal year 2007, with two option years.

Procurement Information
Section 17-71 (b) of the Rockville City Purchasing Ordinance states that “The City may contract with any contractor who offers goods, services, insurance, or construction on the same terms as provided other state or local governments or agencies thereof who have arrived at those terms through a competitive procurement procedure similar to the procedure used by the City.”

Fiscal Impact
Funding is available in the Athletic Courts Improvements CIP account (420-900-4M61).

Next Steps
The Purchasing Office will issue a contract to American Tennis Courts, Inc.
