Award of Bid #21-09 for the annual concrete maintenance program.

Recommendation
Award of Bid #21-09 for the annual concrete maintenance program to the three lowest responsible bidders: A. J. Romano Construction of Laurel, Maryland; D&F Construction Inc of Forestville, Maryland; and M Luis Construction Inc. of Baltimore, Maryland in an aggregate amount not to exceed $2,000,000.

Discussion

The annual concrete maintenance program provides contracted construction services for repair, replacement, and maintenance of the City’s infrastructure, including: concrete curbs, sidewalks, storm drain inlets, bridge repairs, minor asphalt repairs, and other minor construction projects as necessary. This program also funds the installation of new driveway aprons, minor geometric intersection improvements, pedestrian safety improvements, and improvements to keep the City in compliance with ADA requirements.

Award to the three lowest bidders ensures an adequate work force and response time. The work is generally done in response to citizen requests for work, citizen complaints, and evaluation of conditions by staff.

Staff prepared and publicly advertised Bid #21-09 in December 2008. Bid information was electronically provided to 791 prospective bidders via e-Maryland Marketplace, the State of Maryland's internet based e-procurement system. Fifteen bids were received as follows:

A non-responsive bid was received from G&D Construction, LLC; the contractor failed to submit the required bid bond with their bid.

Notes on the bid

The bid amounts shown are based on estimated quantities. These estimates were developed using a three-year average of actual quantities used as well as other anticipated work. The "amounts based on estimated quantities" above are for bid evaluation purposes only and do not reflect an obligation by the City for specific amounts to specific bidders. Total payments to the three lowest bidders shall not exceed $2,000,000 for the period through December 31, 2009. The purpose of awarding this bid to multiple bidders is to assure an adequate pool of manpower and resources and to minimize delays in responding to work requests.

References

Staff reviewed all references and found all to be acceptable. Staff also has a successful history with all three companies on previous City projects, either as a primary or sub-contractor.

Fiscal Impact
Funding is provided through several CIP accounts, including: asphalt maintenance program (420-850-8H11), concrete maintenance program (420-850-7F11), pedestrian safety (420-850-4B71), and others as appropriate. Funding beyond June 30, 2009 is contingent upon Mayor and Council approval of the FY10 Capital Improvements Program.
