Authorization to File Zoning Text Amendment

Recommendation
Authorize Filing.

Change in Law or Policy
The proposed text amendment is for the purpose of making technical and clarifying corrections to the comprehensive revision of the Zoning Ordinance.

Discussion
On December 15, 2008 the Mayor and Council adopted ordinance 19-08 to approve the comprehensive revisions to the City's Zoning Ordinance, being Chapter 25 of the City Code. In reviewing the text the staff has noted a few additions and corrections that need to be made. These corrections are a result of editing and are generally clarifications or typographic errors - the large majority of the revisions are not intended to change the intent of the adopted ordinance. Some of the proposed modifications have resulted from recent experience with administering the review process for new applications. The corrections proposed are detailed in Attachment B, the attachment to the text amendment application. Underlining indicates new text to be added. Text within bold brackets is text proposed to be deleted. Authorization for introduction is the first step in this process. As the proposed amendment proceeds through further staff review, Planning Commission review, and public hearing testimony, further changes to the text amendment may be made prior to final action by the Mayor and Council.

Note that formatting changes, such as paragraph indents, are not included since they do not change the actual language of the text. These formatting issues will be addressed as part of preparing a final published version of the text.

Mayor and Council History
This is the first time this item has been brought before the Mayor and Council.

Public Notification and Engagement
Once filed, notice will be provided via mail to all civic associations, homeowner's associations, and other interested parties. A public hearing before the Mayor and Council is required, and will be advertised in the local newspaper.

Boards and Commissions Review
The proposed text amendment will be reviewed by the Planning Commission prior to the public hearing before the Mayor and Council.

Fiscal Impact
These amendments are minor and editorial in nature and therefore, have no fiscal impact.

Next Steps
The tentative schedule for processing this text amendment is as follows:
July 22 - Planning Commission Review and Recommendation
September 14 - Public Hearing before Mayor and Council
October 5 - Discussion and Instruction
October 26 - Introduce and Adopt Ordinance

If additional text revisions are minor as a result of the public hearings, the Mayor and Council could shorten the adoption schedule.
