Introduction of an amendment to the Incorporation of Works of Art in Public Architecture Ordinance
The Cultural Arts Commission and staff unanimously support and recommend the introduction of the modified language to the Incorporation of Works of Art In Public Architecture Ordinance.
Change in Law or Policy
The proposed ordinance would amend Chapter 4 of the Rockville City Code entitled "Arts and Cultural Affairs" to require the City Manager to consult with the Cultural Arts Commission prior to making a determination regarding the applicability of the Incorporation of the Works of Arts in Public Architecture Ordinance to a specific project. At this time, Chapter 4 requires the City Manager to make a determination as to the applicability and/or implementation of this article prior to review of the Cultural Arts Commission (via the proposed operating budget). The benefit or advantage of the amended language is to ensure that funding is designated for projects that the Cultural Arts Commission recommends prior to their inclusion in the proposed operating budget.
Additionally, the proposed ordinance would provide greater flexibility in how the required works of art contribution is allocated; rather than being limited to the specific City construction project on which the allocation is based, the Cultural Arts Commission could recommend that some of the monies be appropriated for future projects. This proposed amendment is based on the Commission's past experience with projects that did not require the full allocation and the value of identifying future better uses of the funds. With this amendment, the unused funds would be set aside and accumulate for a future art project any time the full allocation is not needed.
Mayor and Council History
On April 30, 2012, the Mayor and Council approved the recommended changes to the Incorporation of Works of Art in Public Architecture Ordinance. Staff was directed to submit the changes to the City Attorney's Office for preparation of an ordinance to implement the revisions.
Public Notification and Engagement
The approved minutes of the Cultural Arts Commission's March 14, 2012 meeting reflect the discussion and recommendations of the proposed changes to the Incorporation of Works of Art in Public Architecture Ordinance. The approved minutes of the Cultural Arts Commission's October 10, 2012 meeting reflect approval of the wording prepared by the City's legal staff based on the Commission's recommendation and approval of the Mayor and Council. The approved minutes are attached and were posted on the City of Rockville website.
Boards and Commissions Review
The Cultural Arts Commission was involved throughout the process and unanimously supported and recommended the changes to the Incorporation of Works of Art in Public Architecture Ordinance.
Adoption of the ordinance is scheduled for January 28, 2013.
