Authorization to Grant a Stormwater Management Easement and Maintenance Covenant at the Water Treatment Plant to Montgomery County.
Staff recommends that the Mayor and Council authorize the City Manager to execute documents, in a form acceptable to the City Attorney, to grant a 0.14-acre Stormwater Management Easement and Maintenance Covenant at the Water Treatment Plant to Montgomery County.
This item will authorize the City Manager to execute a 0.14-acre Stormwater Management (SWM) Easement and Maintenance Covenant at the Rockville Water Treatment Plant (WTP) to Montgomery County. The SWM easement allows Montgomery County access to this water quality structure located at the WTP so it can inspect the structure and provide maintenance if Rockville fails to adequately maintain the structure; the maintenance covenant requires Rockville to maintain the water quality structure.
This SWM easement and maintenance covenant document is similar to that required by the City for privately owned on-site SWM facilities. Montgomery County required Rockville to install this water quality SWM facility to fulfil SWM regulatory requirements for the proposed construction of the new gravity thickener and air scour system at the WTP. Attachment A shows the location of the SWM structure and the easement.
The new gravity thickener will expand the WTP capacity to better manage the solids and recycled water flows during optimized plant system operations and provide redundancy for reliable operations. The new air scour system replaces the nonfunctional surface wash system and will improve the treatment and operational effectiveness of the filters. The proposed improvements are part of the WTP Upgrades and Water System Facility Improvements CIP projects (Attachment B), which are currently advertised for construction bid.

This is the first time this item has been brought before the Mayor and Council.
The City Manager will execute, on behalf of the Mayor and Council of Rockville and in a form acceptable to the City Attorney, a SWM Easement and Maintenance Covenant at the WTP. The documents will be recorded in the Montgomery County Land Records after execution.
